Why Bobrisky can’t be arrested for declaring himself gay— Festus Kiyamo

Indication that Bobrisky was arrested based on his confession that he is a gay as the reason behind his arrest in Lagos yesterday has been refuted by the human right lawyer, Festus Kiyamo, saying there is no evident he actually committed the crime.

The socialite, born Okuneye Idris Olarenwaju, was in a rift online with stalkers and must have been pushed off limit when he snapped that he was a gay. The statement took most people by shock, not literally because he said it, but for the boldness he summoned to have typed such statement on social media with millions of users who are well familiar with the fact that being a gay or lesbian is punishable with 14 years jail under Nigerian law.

Though the crossdresser and self-acclaimed Nigerian male barbie doll had deleted the post, the imprintable graffitti ever remains in the mind of fans and foes alike.

Although Bobrisky had linked source of his predicament to serial entrepreneur, Toyin Lawani, many still feel it has to do his sexual orientation he publicly declared.

Speaking why anyone cannot be arrested for declaring himself criminal, Mr Kiyamo who spoke with Linda Ikeji’s Blog, said Bobrisky needed to be caught in the act before police can arrest him.

His words: “For me, you have to be caught in the act. Yes, it may amount to corrupting public moral when you go on social media to announce you are gay but we are talking about the law here and not sentiment and if we are talking about the law, the person has to be caught in the act. Except the person says he is gay and refers to a particular gay act that can be verified.

“For example, if Mr.A comes out on social media to say I am a thief, he cannot be arrested because his declaration that he is a thief cannot be linked to a particular act of stealing. Anybody can come out to say I am a kidnapper but if you do not link that declaration to a particular incident that happened, that person cannot be arrested. So also, if a person comes out to say I am gay and you can’t link it to a particular gay act that actually happened or that he was caught in the act, I think it is wrong for such a person to be arrested.

“You can only be arrested when you consent to the act that can be verified. He can be arrested for saying that he is gay but it must be linked to a gay act that happened. You cannot be arrested for just saying you are gay”

Toyin Lawani set me up— Bobrisky

Toyin Lawani asked her lawyer to write petitions against me that I worked for her and I’m selling cream to all her customers. Which was a fat lie. I never worked for Toyin. She was my friend. I can’t remember ever working for Toyin or learning how to make cream from her.

“Then she also said I threatened her. So we are going to Abuja cos that was where the case was reported. Before she wrote petitions against me, she had already threatened me that she is giving me 7 days to go to the internet and apologize to her which I said no way because she offended me. I think because I refused to apologize, she got the police involved

“Yesterday at the police station, I was sitting at the counter and I was told I needed to wait until morning to go to Abuja. My phone was taken from me so I couldn’t talk to anyone. I’m trying to get in touch with my lawyer and all the people I know.”
